ข้อกำหนดและเงื่อนไขในการใช้งานบริการ Fleet Telematics Service

ข้อกำหนดและเงื่อนไขฉบับนี้ (“ข้อกำหนดและเงื่อนไข ”) เป็นข้อกำหนดและเงื่อนไขสำหรับการใช้บริการ Fleet Telematics Service ทั้งในส่วนของเว็บไซต์ และ แอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟน (ต่อไปนี้เรียกว่า “Fleet Telematics Service”) ซึ่งให้บริการโดยบริษัท โตโยต้า มอเตอร์ ประเทศไทย จำกัด มีสำนักงานแห่งใหญ่ตั้งอยู่ที่ 186/1 หมู่ 1 ถนนทางรถไฟเก่า ตำบลสำโรงใต้ อำเภอพระประแดง จังหวัดสมุทรปราการ 10130 (ต่อไปนี้เรียกว่า “โตโยต้า”)

กรุณาอ่านข้อกำหนดและเงื่อนไขฉบับนี้ รวมทั้งนโยบายความเป็นส่วนตัวของโตโยต้าโดยละเอียด การที่ท่านเลือก “ยอมรับ” เป็นการที่ท่านให้การรับรองว่าท่านได้อ่าน เข้าใจ และตกลงผูกพันตนต่อข้อกำหนดและเงื่อนไขต่างๆ เหล่านี้ รวมถึงนโยบายความเป็นส่วนตัวของโตโยต้า และรับทราบว่า ข้าพเจ้ามีสิทธิที่จะเพิกถอนความยินยอมการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลตามหนังสือฉบับนี้ได้ตลอดเวลา โดยส่งคำร้องตามช่องทางที่กำหนดไว้ในนโยบายความเป็นส่วนตัวของโตโยต้า ดังกล่าว

1. คำจำกัดความ

ในข้อกำหนดและเงื่อนไขฉบับนี้ ให้คำต่อไปนี้มีความหมายดังนี้

1.1) ผู้ขอใช้บริการหรือท่าน หมายถึง บุคคลซึ่งตกลงตามข้อกำหนดและเงื่อนไขฉบับนี้

1.2) รหัสประจำตัวผู้ขอใช้บริการ หมายถึง รหัสประจำตัวที่ได้รับและได้จัดให้จากการลงทะเบียนเพื่อใช้ Fleet Telematics Service

1.3) Fleet Telematics Service หมายถึง การให้บริการและเนื้อหาที่เกี่ยวข้องที่สามารถเข้าถึงได้ผ่านทางเว็บไซต์ www.toyotafts.com และ/หรือ แอปพลิเคชัน Fleet Telematics Service บนโทรศัพท์มือถือแบบสมาร์ทโฟน (ตามที่ได้ให้คำจำกัดความด้านล่างนี้) ไม่ว่าจะเป็นการให้บริการที่ต้องชำระค่าบริการหรือการให้บริการฟรี

1.4) รถยนต์ หมายถึง รถยนต์ที่ติดตั้ง DCM (ตามที่ได้ให้คำจำกัดความด้านล่างนี้) ซึ่งรองรับการเชื่อมต่อ และเข้าใช้งาน Fleet Telematics Service

1.5) DCM หมายถึง อุปกรณ์อิเล็กทรอนิกส์ที่ทำหน้าที่ในการส่งสัญญาณข้อมูลรถยนต์

1.6) TCAP หมายถึง บริษัท โตโยต้า คอนเนคเต็ด เอเชีย แปซิฟิค จำกัด ซึ่งทำหน้าที่ในการพัฒนาระบบ

1.7) Yazaki หมายถึง บริษัท ไทย ยาซากิ เน็ตเวิร์ค เซอร์วิส จำกัด ซึ่งทำหน้าที่ในการพัฒนาระบบ เว็บไซต์ และ แอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟน

1.8) ค่าบริการ หมายถึงจำนวนเงินที่พึงชำระให้แก่ โตโยต้า สำหรับการใช้บริการ Fleet Telematics Service

1.9) แอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟน หมายถึงซอฟต์แวร์ที่จัดให้มีอยู่ในแอพสโตร์ (AppStore) ของระบบปฏิบัติการ IOS หรือใน Google Play ของระบบปฏิบัติการ Android เพื่อให้สามารถเข้าใช้บริการ Fleet Telematics Service ได้

2. การเปลี่ยนแปลงแก้ไขข้อกำหนดและเงื่อนไข และ/หรือ Fleet Telematics Service

2.1) โตโยต้า มีสิทธิเปลี่ยนแปลงแก้ไขข้อกำหนดและเงื่อนไขฉบับนี้ เมื่อ โตโยต้า กระทำเช่นนั้น จะมีการนำเสนอข้อกำหนดและเงื่อนไขใหม่นั้นแก่ท่านเพื่อให้ท่านให้การยอมรับ ผ่านทางเว็บไซต์หรือแอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟน หากท่านได้ยอมรับข้อกำหนดและเงื่อนไขดังกล่าวแล้ว ข้อกำหนดและเงื่อนไขใหม่นั้นจึงจะมีผลบังคับใช้ทันที หรือ ตามที่ระบุไว้ในข้อกำหนด หรือ เงื่อนไขฉบับนั้นๆ หากท่านไม่ยอมรับข้อกำหนดและเงื่อนไขใหม่ ท่านสามารถปฎิเสธข้อกำหนดและเงื่อนไขดังกล่าวได้ หากแต่การปฎิเสธดังกล่าวอาจส่งผลต่อการใช้บริการ Fleet Telematics Service ในบางบริการ รวมถึงเมื่อสิ้นสุดระยะเวลาการให้บริการ Fleet Telematics Service ของท่านในเวลานั้นแล้ว ท่านจะต้องหยุดใช้ Fleet Telematics Service และลบแอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟนออก

2.2) โตโยต้า สามารถเพิ่ม นำออกไป หรือเปลี่ยนแปลงแก้ไขการบริการ Fleet Telematics Service ไม่ว่าบางส่วนหรือทั้งหมดได้ โดยไม่ต้องแจ้งให้ท่านทราบ

2.3) โตโยต้า อาจทำการปรับปรุงข้อมูลของ (update) Fleet Telematics Service และ/หรือแอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟนได้ เป็นครั้งคราว การปรับปรุงข้อมูลดังกล่าวมีขึ้นเพื่อวัตถุประสงค์ในการปรับปรุงและ/หรือพัฒนา Fleet Telematics Service เพิ่มเติม และ/หรือลดการเกิดข้อบกพร่องหรือการทำงานผิดปกติ ทั้งนี้ในส่วนที่เกี่ยวข้องกับการปรับปรุงข้อมูลดังกล่าว อาจมีการเปลี่ยนแปลงมาตรฐานทางด้านเทคนิคขั้นต่ำสุดต่างๆ ได้เป็นครั้งคราว

3. การใช้บริการ Fleet Telematics Service

3.1) Fleet Telematics Service ประกอบด้วยบริการต่างๆ ดังต่อไปนี้

3.1.1) หน้าควบคุม / Dashboard

3.1.2) ตรวจพิกัดรถ / Monitor

3.1.3) ดูย้อนหลัง / Playback

3.1.4) ระบบจัดการข้อมูล / Management

3.1.5) รายงาน / Report

3.1.6) ตั้งค่าระบบ / System Setting

3.1.7) แจ้งปัญหาการใช้งาน / Contact Admin

การให้บริการบางรายการของ Fleet Telematics Service มีให้บริการเฉพาะบนเว็บไซด์เท่านั้น บางรายการมีให้บริการเฉพาะในแอปพลิเคชันโทรศัพท์มือถือแบบสมาร์ทโฟน และบางรายการมีให้บริการได้ทั้งสองช่องทาง

3.2) Fleet Telematics Service รองรับการให้บริการเฉพาะในราชอาณาจักรไทยเท่านั้น

3.3) การใช้บริการ Fleet Telematics Service ท่านต้องลงทะเบียนเพื่อขอใช้บริการ Fleet Telematics Service ให้เสร็จสิ้นก่อน ซึ่งขั้นตอนนี้เกี่ยวข้องกับการสร้างรหัสประจำตัวผู้ใช้และรหัสผ่าน รวมถึงสิทธิในการเข้าใช้งานเว็บไซด์ และแอปพลิเคชัน

3.4) บริการหลายรายการของ Fleet Telematics Service ขึ้นอยู่กับการสื่อสารข้อมูลผ่านเครือข่ายโทรศัพท์มือถือและ/หรือ GPS ไม่ว่าจะผ่านทางโทรศัพท์มือถือแบบสมาร์ทโฟน หรือ DCM การทำงานของ Fleet Telematics Service ขึ้นอยู่กับผู้ให้บริการเครือข่ายโทรศัพท์มือถือของท่านไม่มากก็น้อย บริการหลายรายการของ Fleet Telematics Service ไม่สามารถให้บริการได้ หรืออาจมีคุณภาพลดลงในสถานการณ์ต่อไปนี้

3.4.1) โทรศัพท์มือถือแบบสมาร์ทโฟนหรือ DCM รับสัญญาณได้ไม่เพียงพอ

3.4.2) การรับบริการจากผู้ให้บริการเครือข่ายถูกจำกัดหรือสิ้นสุด เช่น ถูกจำกัดหรือสิ้นสุดอันเนื่องมาจากการใช้ข้อมูลแบบความเร็วสูงหมดแล้ว

3.4.3) ระดับสัญญาณ GPS ได้ไม่เพียงพอในพื้นที่ดังกล่าว

3.5) ในบริการตรวจพิกัดรถบทบาทหน้าที่ของโตโยต้า มีจำกัดเพียงการให้ข้อมูลตำแหน่งสุดท้ายของรถยนต์ที่ระบบจัดให้แก่ท่านได้เท่านั้น ซึ่งการทำงานนี้สามารถช่วยได้ในกรณีที่ท่านต้องการทราบว่ารถยนต์ของท่านอยู่ที่ใด การมีบริการดังกล่าวพร้อมใช้งานและความถูกต้องของข้อมูลดังกล่าวขึ้นอยู่กับปัจจัยต่างๆ ในข้อ 3.4 ข้างต้น หากท่านคิดว่ารถยนต์ของท่านถูกโจรกรรม อย่าพยายามนำรถยนต์ของท่านคืนมาด้วยตัวท่านเอง ในกรณีนี้ ท่านจะต้องติดต่อเจ้าหน้าที่ตำรวจ แจ้งความต่อเจ้าหน้าที่ตำรวจ และดำเนินการให้เจ้าหน้าที่ตำรวจเป็นผู้นำรถยนต์ของท่านที่ถูกโจรกรรมคืนมาให้ท่าน

4. ค่าบริการ

4.1) ค่าบริการจะระบุไว้ในใบสมัครใช้บริการ Fleet Telematics Service หรือแบบฟอร์มเปลี่ยนแปลง / ต่ออายุการใช้บริการ Fleet Telematics Service ค่าบริการจะเป็นค่าให้บริการในระยะเวลาตามที่ระบุไว้ในคำสั่งให้มีการให้บริการ Fleet Telematics Service ที่สมบูรณ์แต่ละคำสั่ง ทั้งนี้ โตโยต้า สงวนสิทธิในการเปลี่ยนแปลงค่าบริการ Fleet Telematics Service โดยมิต้องแจ้งให้กับทางท่านทราบล่วงหน้า

4.2) ท่านสามารถชำระค่าใช้บริการ Fleet Telematics Service ผ่านช่องทางที่ระบุไว้ในใบสมัครใช้บริการ Fleet Telematics Service หรือแบบฟอร์มเปลี่ยนแปลง / ต่ออายุการใช้บริการ Fleet Telematics Service

4.3) ท่านเป็นผู้รับผิดชอบต่อสัญญาต่างๆ ของท่านกับผู้ให้บริการเครือข่ายโทรศัพท์มือถือของท่าน ด้วยตัวท่านเอง และท่านเป็นผู้รับผิดชอบต่อการเรียกเก็บเงินใดๆ สำหรับการนั้น

5. ความรับผิดชอบของผู้ขอใช้บริการ

5.1) ท่านจะต้องเก็บรหัสประจำตัวผู้ใช้และรหัสผ่านสำหรับ Fleet Telematics Service ไว้เป็นความลับ ท่านจะต้องไม่ให้บุคคลอื่นใดทราบรหัสประจำตัวผู้ใช้ของท่าน ท่านจะต้องไม่อนุญาตให้บุคคลอื่นใดใช้รหัสประจำตัวผู้ใช้ของท่าน และท่านต้องไม่ใช้รหัสประจำตัวผู้ใช้ของบุคคลอื่นใด ท่านเป็นผู้รับผิดชอบต่อการกระทำและผลต่างๆ ของการกระทำทั้งปวงอันเกิดขึ้นจากการใช้รหัสประจำตัวผู้ใช้ของท่าน ไม่ว่าการกระทำนั้นจะกระทำขึ้นโดยท่านหรือไม่

5.2) หากท่านโอน/ให้ รถยนต์ที่ได้มีการลงทะเบียน หรือ ระบุไว้กับ Fleet Telematics Service แอปพลิเคชัน หรือโอน/ให้โทรศัพท์มือถือแบบสมาร์ทโฟนที่มีแอปพลิเคชันนี้ให้แก่บุคคลภายนอก ท่านต้องรับผิดชอบในการลบข้อมูลของรถยนต์คันดังกล่าวออกจาก Fleet Telematics Service แอปพลิเคชัน บนโทรศัพท์มือถือแบบสมาร์ทโฟน (ตามที่เกี่ยวข้อง) และลบข้อมูลทั้งหมดของท่านออกจากอุปกรณ์เหล่านั้น

5.3) หากท่านได้รับโทรศัพท์มือถือแบบสมาร์ทโฟนที่มีแอปพลิเคชันดังกล่าวจากบุคคลภายนอก และท่านประสงค์ที่จะใช้ Fleet Telematics Service ท่านจะต้องลงชื่อเข้าใช้ โดยใช้รหัสประจำตัวผู้ใช้และรหัสผ่านของท่านเอง และท่านจะต้องไม่ใช้ข้อมูล/สิ่งรับรองตัวตนของบุคคลอื่นใด

5.4) เมื่อท่านได้เปลี่ยนแปลงข้อมูลในการติดต่อ ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะหมายเลขโทรศัพท์ ที่อยู่ หรืออีเมล ท่านจะต้องแจ้งให้ทางโตโยต้าทราบ

5.5) ท่านต้องปฏิบัติตามกฎหมายทั้งปวงเมื่อใช้บริการ Fleet Telematics Service

6. ความรับผิดชอบต่ออุปกรณ์

6.1) หากท่านใช้แอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟน ท่านจะเป็นผู้รับผิดชอบต่อสมาร์ทโฟน ระบบปฏิบัติการของสมาร์ทโฟน การตั้งค่าของสมาร์ทโฟน ซอฟต์แวร์ของบุคคลภายนอกที่ติดตั้งบนสมาร์ทโฟน และอุปกรณ์เสริมของบุคคลภายนอกที่ติดตั้งบนสมาร์ทโฟนดังกล่าว แอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟนต้องใช้การเชื่อมต่อข้อมูลจากผู้ให้บริการเครือข่ายโทรศัพท์มือถือและ GPS ของท่าน เพื่อที่จะสามารถทำงานได้อย่างถูกต้อง ดังนั้น กรุณาตั้งค่าการอนุญาตต่างๆ ให้สอดคล้อง กรุณาอย่าใช้แอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟน บนอุปกรณ์ที่ผ่านการเจลเบรก (jailbroken) หรือรูท (rooted) เนื่องจากอุปกรณ์ดังกล่าวอาจรบกวนการทำงานปกติของแอปพลิเคชันนี้ได้

6.2) ท่านจะเป็นผู้รับผิดชอบต่อสัญญาต่างๆ ที่ทำกับผู้ให้บริการเครือข่ายโทรศัพท์มือถือของท่าน ตามที่มีความจำเป็นเพื่อใช้บริการ Fleet Telematics Service รวมถึงแต่ไม่จำกัดเฉพาะการให้ใช้ข้อมูลแบบความเร็วสูงได้อย่างเพียงพอ

7. การหยุดให้บริการ Fleet Telematics Service ชั่วคราว

โตโยต้า อาจหยุดหรือจำกัดการให้บริการ Fleet Telematics Service ชั่วคราว เป็นบางครั้งคราว ไม่ว่าจะมีการบอกกล่าวให้ท่านทราบหรือไม่ สถานการณ์ที่ โตโยต้า อาจหยุดหรือจำกัดการบริการ Fleet Telematics Service เป็นการชั่วคราว มีตัวอย่างดังต่อไปนี้

7.1) การซ่อมบำรุงระบบต่างๆ ของ Fleet Telematics Service ไม่ว่าจะได้กำหนดเวลาไว้แล้วหรือไม่

7.2) เหตุสุดวิสัย เช่น เพลิงไหม้ ไฟฟ้าดับ แผ่นดินไหว ภูเขาไฟปะทุ น้ำท่วม สึนามิ สงคราม การก่อความไม่สงบ หรือโรคระบาด ฯลฯ ที่กระทบต่อระบบต่างๆ ของ Fleet Telematics Service

7.3) การเดินขบวนประท้วงของคนงานหรือการนัดหยุดงานที่มีผลกระทบต่อระบบต่างๆ ของ Fleet Telematics Service

7.4) ปัญหาการเชื่อมต่อข้อมูลที่เกิดขึ้นระหว่าง Fleet Telematics Service กับเครือข่ายของบุคคลภายนอก

7.5) ปัญหาทางเทคนิคหรือปัญหาเกี่ยวกับการปฏิบัติการปัญหาอื่นๆ ที่กระทบต่อความสามารถของโตโยต้าในการจัดให้ซึ่งการบริการ Fleet Telematics Service

8. ทรัพย์สินทางปัญญา

8.1) โตโยต้า เป็นเจ้าของสิทธิใดๆ กรรมสิทธิ์ และประโยชน์ทั้งปวงในการบริการ Fleet Telematics Service รวมถึงเว็บไซด์ และแอปพลิเคชันบนโทรศัพท์มือถือแบบสมาร์ทโฟน ไม่ว่าจะที่มีอยู่ในรูปแบบของสิทธิบัตร เครื่องหมายการค้า ลิขสิทธิ์ ความลับทางการค้า หรือทรัพย์สินทางปัญญาในรูปแบบอื่นๆ ไม่ว่าจะได้รับจดทะเบียนแล้วหรือยังไม่ได้รับจดทะเบียน (เรียกรวมกันว่า “ทรัพย์สินทางปัญญาที่เกี่ยวกับ Fleet Telematics Service” )

8.2) ตามเงื่อนไขและข้อกำหนดฉบับนี้ ท่านได้รับอนุญาตโดยจำกัดและท่านไม่สามารถโอนสิทธิในการใช้ทรัพย์สินทางปัญญาที่เกี่ยวกับ Fleet Telematics Service ตามที่จำเป็นสำหรับการใช้บริการ Fleet Telematics Service ของท่านซึ่งเป็นสิทธิในการใช้เพื่อส่วนตัวเท่านั้น ตามแผนของการสมัครใช้บริการดังกล่าวของท่านที่ยังมีผลใช้ได้อยู่ ห้ามไม่ให้มีการใช้ในลักษณะอื่นทั้งปวง ท่านไม่มีสิทธิอื่นๆ ในทรัพย์สินทางปัญญาที่เกี่ยวกับ Fleet Telematics Service ใดๆ แต่ประการใดทั้งสิ้น

8.3) ท่านต้องไม่ทำซ้ำ เปลี่ยนแปลงแก้ไข ทำการวิศวกรรมย้อนกลับ ขาย หรือ จำหน่ายจ่ายแจก ทรัพย์สินทางปัญญาที่เกี่ยวข้องกับ Fleet Telematics Service และท่านต้องไม่มอบอำนาจหรืออนุญาตให้บุคคลภายนอกใดๆ กระทำการดังกล่าว

9. การชดใช้และการจำกัดความรับผิด

9.1) หากท่านกระทำผิดข้อกำหนดและเงื่อนไขฉบับนี้ ท่านตกลงจะชดใช้แก่ โตโยต้า โดยเต็มที่ เกี่ยวกับความเสียหายทั้งปวงที่ โตโยต้า อาจได้รับจากการนั้น

9.2) เท่าที่กฎหมายอนุญาต ทางโตโยต้า ไม่มีความรับผิดแต่ประการใด ต่อหรือที่เกิดขึ้น อันเกี่ยวกับสิ่งต่อไปนี้

9.2.1) ปัญหาต่างๆ เกี่ยวกับเครือข่ายที่ปฏิบัติการโดยบุคคลภายนอก

9.2.2) ปัญหาเกี่ยวกับอุปกรณ์ของท่าน ไม่ว่าจะเป็นโทรศัพท์มือถือแบบสมาร์ทโฟนหรือบริการใดๆ ของผู้ให้บริการเครือข่ายโทรศัพท์มือถือ

9.2.3) การที่ท่านไม่ได้แจ้งปรับปรุงข้อมูลส่วนบุคคลของท่านให้ โตโยต้า ทราบ

9.2.4) การที่ท่านไม่ปฏิบัติตามข้อกำหนดและเงื่อนไขฉบับนี้ในประการใดๆ

10. การบอกเลิกสัญญา

10.1) โตโยต้า หรือ Yazaki หรือ TCAP อาจบอกเลิกสิทธิของท่านในการใช้ Fleet Telematics Service โดยการบอกกล่าวและมีผลทันที ในกรณีที่ท่านกระทำผิดในสาระสำคัญของข้อกำหนดและเงื่อนไขนี้ การกระทำผิดข้อกำหนดและเงื่อนไขในสาระสำคัญรวมไปถึงและโดยไม่จำกัดเพียง อาทิเช่น การไม่ชำระค่าบริการหรือการกระทำผิดข้อกำหนดไม่ว่าข้อใดก็ตามของข้อกำหนดและเงื่อนไขฉบับนี้เกี่ยวกับเรื่องทรัพย์สินทางปัญญาที่เกี่ยวกับ Fleet Telematics Service

10.2) ท่านสามารถแจ้งยกเลิกการใช้บริการ Fleet Telematics Service โดยกรอกแบบฟอร์มเปลี่ยนแปลง / ต่ออายุการใช้บริการ Fleet Telematics Service แล้วส่งมาที่ โตโยต้า

10.3) ข้อกำหนดต่างๆ ในข้อกำหนดและเงื่อนไขฉบับนี้เกี่ยวกับทรัพย์สินทางปัญญาของ Fleet Telematics Service ข้อมูลส่วนบุคคล การชดใช้ และการจำกัดความรับผิด ให้มีผลบังคับใช้ต่อไปแม้สิ้นสุด/มีการบอกเลิกข้อกำหนดและเงื่อนไขฉบับนี้

11. การบอกกล่าว

12. กฎหมายที่ใช้บังคับและข้อกำหนดทั่วไป

ข้อกำหนดและเงื่อนไขฉบับนี้อยู่ใต้บังคับตามกฎหมายไทย ข้อกำหนดและเงื่อนไขฉบับนี้เป็นข้อตกลงทั้งหมดระหว่างคู่สัญญาตามข้อกำหนดและเงื่อนไขฉบับนี้ในเรื่องที่เกี่ยวกับข้อกำหนดและเงื่อนไขฉบับนี้ หากข้อกำหนดไม่ว่าข้อใดในข้อกำหนดและเงื่อนไขนี้ถูกตัดสินว่าไม่สมบูรณ์หรือไม่สามารถใช้บังคับได้ ให้ข้อกำหนดที่เหลือยังคงสามารถใช้บังคับได้โดยเต็มที่ ผู้ใช้ไม่สามารถโอนสิทธิต่างๆ ของตนหรือมอบหน้าที่ต่างๆ ของตนให้แก่บุคคลภายนอกใดๆ โดยไม่ได้รับความยินยอมเป็นหนังสือจาก โตโยต้า ก่อน

ข้อกำหนดและเงื่อนไขนี้มีผลใช้ตั้งแต่วันที่ 11 มิถุนายน 2563 เป็นต้นไป

Terms and Conditions

This Terms and Conditions agreement (“Terms and Conditions”) represents Terms and Conditions for the use of services of the Fleet Telematics Service for both website and smartphone application (hereinafter referred to as “Fleet Telematics Service”) provided by Toyota Motor Thailand Co., Ltd. with the registered address at 186/1 Moo 1, Old Railway Road, Tambol Samrong Tai, Amphoe Phra Pradaeng, Samut Prakan Province, 10130, Thailand (hereinafter referred to as “Toyota”.)

Please carefully read the following Terms and Conditions and also Toyota Privacy Policy. By choosing “Accept”, it is deemed that you have certified that you have read, understood and agreed to these Terms and Conditions and also Toyota Privacy Policy and acknowledge that I have the right to withdrawn my consent for Toyota to collect, use and disclose my personal data in this contract anytime by send requirement through our contact channels which set out in Toyota Privacy Policy.

1. Definitions

Under the Terms and Conditions stated herein, the terms below shall have the following definitions.

1.1) ‘Applicant’ or ‘You’ shall refer to a person agreed to this Terms and Conditions agreement.

1.2) ‘User ID’ shall refer to a given identification number received and provided from the registration to use Fleet Telematics Service.

1.3) ‘Fleet Telematics Service’ shall refer to the provision of relevant services and contents which can be accessible via www.toyotafts.com website and/or the Fleet Telematics Service application on smartphones (as defined below) be they payable or free-of-charge.

1.4) ‘Car’ shall refer to a car that is equipped with a DCM (as defined below) which can be connected to and allow for the use of the Fleet Telematics Service.

1.5) ‘DCM’ shall refer to a data communication module which is used to communicate car information signals.

1.6) ‘TCAP’ shall refer to Toyota Connected Asia Pacific Co., Ltd. whose duties include developing systems

1.7) ‘Yazaki’ shall refer to Thai Yazaki Network Service Co., Ltd. whose duties include developing systems and the Fleet Telematics Service application.

1.8) ‘Service Fee’ shall refer to an amount of money to be paid to Toyota for the use of Fleet Telematics Service.

1.9) ‘Application on Smartphone’ shall refer to software provided in Apple’s App Store or Google Play to enable access to Fleet Telematics Service.

2. Changes or Amendments to Terms and Conditions and/or Fleet Telematics Service

2.1) Toyota has the right to change or amend this Terms and Conditions agreement. Upon doing so, Toyota shall propose the new Terms and Conditions to you for your kind acceptance through the website or the application on smartphone. By accepting said Terms and Conditions, they shall become effective immediately or as specified in the agreement. If you do not accept the new Terms and Conditions, you can refuse to accept them. However, such refusal may affect the use of some Fleet Telematics Service services; and also, upon the end of the existing period of the Fleet Telematics Service services provided to you, you will have to stop using the Fleet Telematics Service services and delete the application from your smartphone.

2.2) Toyota can add, remove, or change/amend the Fleet Telematics Service services either in part or in full without any notice to you.

2.3) Toyota may make updates to Fleet Telematics Service information and/or the application on smartphone occasionally. Such updates are for the purposes of further improvement/development of Fleet Telematics Service and/or mitigation of weaknesses or functional irregularities. Regarding such updates, minimum technical standards may be subject to changes occasionally.

3. Use of Fleet Telematics Service

3.1) Fleet Telematics Service consists of the following services:

3.1.2) Monitor

3.1.3) Playback

3.1.4) Management

3.1.5) Report

3.1.6) System Setting

3.1.7) Contact Admin

The provision of Fleet Telematics Service services depends on different car models. Some services are only applicable on the website or the application on smartphone while others are available on both channels.

3.2) Fleet Telematics Service supports only the services provided within the Kingdom of Thailand.

3.3) In using Fleet Telematics Service services, you must complete the Fleet Telematics Service Application process. This process consists of creating a user ID and a password as well as the website and the application access right.

3.4) Many Fleet Telematics Service services are subject to the communication of information via the mobile phone network and/or GPS regardless of whether the communication is made via a smartphone or a DCM. The Fleet Telematics Service functions based on your mobile phone network service provider to a certain extent. Many Fleet Telematics Service services may not be available or may be of less quality in the following situations.

3.4.1) The smartphone or DCM does not have enough signals.

3.4.2) The receipt of services from the network service provider is limited or ended because, for example, the data high-speed service is used up.

3.4.3) The GPS signal level is not enough in that particular area.

3.5) In providing the Monitor service, the role of Toyota is limited to only providing the last location data of the vehicle available on the system to you. This service is useful when you would like to know your car location. Service availability and data accuracy depend on a number of factors as per Item 3.4 above. If you suspect that your car has been stolen, please do not try to recover your car by yourself. In such case, you must contact police and file a police report, and take relevant actions to have the police return the stolen car to you.

4. Service Fees

4.1) Service fees specified in the Fleet Telematics Service Application Form or the Fleet Telematics Service Change / Renewal Form are those according to the timeframe as per each complete Fleet Telematics Service service instruction. Toyota reserves the right to make changes to Fleet Telematics Service service fees without any prior notice to you.

4.2) You can pay Fleet Telematics Service service fees through channel which specify in the Fleet Telematics Service Application Form or the Fleet Telematics Service Change / Renewal Form

4.3) You shall be responsible for any agreements between you and your mobile phone network service provider by yourself and you shall be responsible for any relevant charges.

5. User’s Responsibility

5.1) You must keep your user ID and password for Fleet Telematics Service confidential. You must not allow other persons to learn of your user ID and must not permit others to use your user ID. Also, you must not use another person’s user ID. You shall be responsible for any actions and consequences of any actions as a result of the use of your user ID regardless of whether you undertake such actions.

5.2) If you transfer/give the car for which the registration is done or specified with the Fleet Telematics Service application or transfer/give the smartphone equipped with this application to a third party; you must be responsible for the deletion of said car from the Fleet Telematics Service application on smartphone (as relevant) and delete all of your data from said device.

5.3) If you have received a smartphone equipped with said application from a third party and you wish to use the Fleet Telematics Service application; you must log in by using your own user ID and password. You are not allowed to use identity authentication data/items of another person.

5.4) Once you have changed your contact data, including but not limited to telephone number, address, or email, you must inform Toyota soonest.

5.5) You must comply with all relevant laws when using Fleet Telematics Service.

6. Responsibility for Relevant Devices

6.1) If you use the application on smartphone, you must be responsible for the smartphone, its operating system and settings, any third-party software installed on the smartphone, and any third-party supplementary device installed on such smartphone. Since the application on smartphone requires connection with data from your smartphone network service provider and GPS, to ensure proper functionality, please set up all permissions to ensure compatibility. Please do not use the application on smartphone with jailbroken or rooted devices as those devices may interrupt the normal operation of this application.

6.2) You shall be responsible for any agreements made with your mobile phone network service provider as required for the use of Fleet Telematics Service, including but not limited to the availability of enough high-speed data quota for use.

7. Temporary Suspension of Fleet Telematics Service Services

Toyota may suspend or limit the provision of Fleet Telematics Service services temporarily on an occasional basis with or without any notice to you. Examples of situations where Toyota may suspend or limit the provision of Fleet Telematics Service services are as follows:

7.1) Repair and maintenance of Fleet Telematics Service systems with or without specific schedules

7.2) Force majeure events such as fire, power outage, earthquake, volcano eruption, flood, tsunami, war, or unrest that may affect Fleet Telematics Service systems

7.3) Protests of workers or strikes that affect Fleet Telematics Service systems

7.4) Problems related to data connections between Fleet Telematics Service and third-party networks

7.5) Technical glitches or problems relating to operations as well as other problems that affect the ability of Toyota to arrange and provide Fleet Telematics Service services

8. Intellectual Property

8.1) Toyota shall own any rights, ownership rights, and benefits connected with Fleet Telematics Service services as well as the Fleet Telematics Service website and smartphone application regardless of whether they are in the forms of patents, trademarks, copyrights, trade secrets or other types of intellectual property and whether they have been registered (hereinafter referred to collectively as “Fleet Telematics Service Intellectual Property.”)

8.2) Under this Terms and Conditions agreement, you are given limited permission and are not allowed to transfer the right to use of the Fleet Telematics Service intellectual property as required for your personal use of the Fleet Telematics Service services according to your currently effective service plan. You are not allowed to use Fleet Telematics Service intellectual property for other purposes and shall, in all circumstances, have no other rights related to the Fleet Telematics Service intellectual property.

8.3) You are prohibited from any reproduction, change or amendment, reverse engineering, sale, or distribution of the Fleet Telematics Service intellectual property. And you shall not empower or authorize any third party to do so.

9. Compensation Payments and Limitation of Liability

9.1) If you have violated this Terms and Conditions agreement, you shall agree to make compensation payments to Toyota in full for all kinds of damage incurred to Toyota as a result of such violation.

9.2) As permitted by law, Toyota shall, in any respect, not be liable for any of or anything related to the following cases.

9.2.1) Any problem related to any network operated by any third party

9.2.2) Any problem related to your device (including smartphone) or any service of any mobile phone network service provider

9.2.3) Your failure to notify Toyota of your personal data updates

9.2.4) Your violation of any part of this Terms and Conditions agreement

10. Termination of Agreement

10.1) Toyota or Yazaki or TCAP may give you a notice to cancel your right to use Fleet Telematics Service and such notice shall be effective immediately in the case where you have violated the spirit of this Terms and Conditions agreement. Such violation includes but is not limited to failure to pay service fees or breaching any provision under this Terms and Conditions agreement with regard to Fleet Telematics Service intellectual property.

10.2) You may notify of cancellation of Fleet Telematics Service services by signing the Fleet Telematics Service Change / Renewal Form

10.3) Provisions under this Terms and Conditions agreement with regard to Fleet Telematics Service intellectual property, personal data, compensation payments, and limitation of liability shall continue to take effect even after the end/notification of cancellation of this Terms and Conditions agreement.

12. Applicable Laws and General Requirements

This Terms and Conditions agreement shall be governed by Thai laws. This Terms and Conditions agreement shall represent all agreements with regard to matters relating to this Terms and Conditions agreement between the parties under this Terms and Conditions agreement. If any part of this Terms and Conditions agreement is found to be invalid or unenforceable, the remaining parts of this Terms and Conditions agreement shall remain fully enforceable. The user shall not transfer his/her rights or assign his/her duties to any third party without Toyota’s prior written consent.

This Terms and Conditions agreement shall be effective from 11 June 2020 onwards.

บริษัท โตโยต้า มอเตอร์ ประเทศไทย จำกัด ("TMT" "เรา" "พวกเรา" หรือ "ของเรา") เล็งเห็นถึงความสำคัญของการคุ้มครองข้อมูลส่วนบุคคลของท่าน (ตามที่นิยามไว้ด้านล่างนี้) ในนโยบายความเป็นส่วนตัวนี้ ("นโยบายฯ") จะอธิบายการเก็บ ใช้ เปิดเผย และ/หรือโอนไปต่างประเทศของข้อมูลส่วนบุคคลของท่านที่ได้รับจากแหล่งต่าง ๆ ตลอดจนสิทธิของท่านและแนวทางปฏิบัติเกี่ยวกับข้อมูลดังกล่าว

TMT เป็นผู้ควบคุมข้อมูลที่เก็บ ใช้ เปิดเผย และโอนไปต่างประเทศซึ่งข้อมูลส่วนบุคคลของท่าน

TMT เป็นนิติบุคคลที่จัดตั้งขึ้นภายใต้กฎหมายของประเทศไทย มีสำนักงานใหญ่ตั้งอยู่ที่ 186/1 หมู่ 1 ถนนทางรถไฟเก่า ตำบลสำโรงใต้ อำเภอพระประแดง จังหวัดสมุทรปราการ 10130

3. ข้อมูลส่วนบุคคลคืออะไร

“ข้อมูลส่วนบุคคล” หมายถึง ข้อมูลใดก็ตามเกี่ยวกับบุคคล ซึ่งทำให้สามารถระบุตัวบุคคลนั้นได้ ไม่ว่าทางตรงหรือทางอ้อม แต่ไม่รวมถึงข้อมูลของผู้ถึงแก่กรรมโดยเฉพาะ

4. ข้อมูลส่วนบุคคลใดที่เก็บรวบรวม

4.1 ข้อมูลส่วนบุคคลที่เราเก็บรวบรวมขึ้นอยู่กับความสัมพันธ์ของท่านกับเรา และบริการหรือผลิตภัณฑ์ที่ท่านต้องการจากเรา ข้อมูลส่วนบุคคลเกี่ยวกับท่านที่เราอาจเก็บรวมรวม ใช้ เปิดเผย และ/หรือโอนไปยังต่างประเทศ รวมถึงแต่ไม่จำกัดเพียงข้อมูลส่วนบุคคลประเภทดังต่อไปนี้

(ก) รายละเอียดส่วนตัว เช่น คำนำหน้าชื่อ ชื่อ นามสกุล เพศ อายุ อาชีพ ตำแหน่งงาน ที่ทำงาน ตำแหน่ง การศึกษา สัญชาติ วันเกิด สถานภาพทางการสมรส ข้อมูลบนบัตรที่ออกโดยรัฐบาล (เช่น เลขที่บัตรประจำตัวประชาชน เลขหนังสือเดินทาง เลขประจำตัวผู้เสียภาษีอากร ข้อมูลใบอนุญาตขับขี่รถยนต์ เป็นต้น) ลายมือชื่อ การบันทึกเสียง การบันทึกการสนทนาทางโทรศัพท์ รูปถ่าย การบันทึกภาพจากกล้องวงจรปิด ทะเบียนบ้าน และข้อมูลประจำตัวอื่น ๆ

(ข) รายละเอียดที่ใช้ติดต่อ เช่น ที่อยู่ หมายเลขโทรศัพท์ หมายเลขโทรสาร ข้อมูลตำแหน่งที่ตั้ง ที่อยู่อีเมล LINE ID บัญชี Facebook Instagram ID และ ID อื่นๆ จากเว็บไซต์เครือข่ายสังคมออนไลน์

(ค) รายละเอียดรถยนต์ เช่น หมายเลขประจำรถยนต์ หมายเลขป้ายทะเบียนรถยนต์ ยี่ห้อ รุ่น ปี สี หมายเลขเครื่องยนต์หมายเลขตัวถังรถ ประเภทรถยนต์ ระยะทางเป็นไมล์ แบตเตอรี่ แรงดันไฟฟ้า ระดับน้ำมัน การสึกหรอของเบรก ข้อมูลตำแหน่งและการเคลื่อน (เช่น เวลา ตำแหน่ง ความเร็ว) รายละเอียดการประกันภัยรถยนต์ ชุดแต่ง/อุปกรณ์ตกแต่ง รายละเอียดของอุปกรณ์เสริมสำหรับ Connected Service (เช่น อุปกรณ์รับส่งสัญญาณ ซิมการ์ด) สมุดคู่มือทะเบียนรถยนต์ เอกสารการตรวจรถยนต์ รายละเอียดข้อมูลที่ได้รับจากการใช้ Connected Services ข้อมูล GPS และตำแหน่งของรถยนต์ รายงานประวัติรถยนต์ และข้อมูลที่เกี่ยวข้องกับรถยนต์อื่นๆ

(ง) รายละเอียดทางการเงิน เช่น ข้อมูลบัตรเครดิตและบัตรเดบิต หมายเลขบัญชีและประเภทของบัญชี ข้อมูลพร้อมเพย์ สินทรัพย์หมุนเวียน รายได้และค่าใช้จ่าย และข้อมูลด้านการเงินอื่นๆ

(จ) รายละเอียดธุรกรรม เช่น รายละเอียดการชำระเงิน วันที่และ/หรือเวลาที่ชำระเงิน จำนวนเงินที่ชำระ วิธีการชำระ รายละเอียดเกี่ยวกับการขอเงินคืน การลงทะเบียน ดอกเบี้ย เงินดาวน์ ค่างวดและจำนวนงวด วันที่และสถานที่ซื้อผลิตภัณฑ์หรือบริการ ที่อยู่/วันที่และเวลารับมอบรถ แบบฟอร์มขอใช้บริการ ใบจองซื้อ ใบตอบรับ ลายมือชื่อผู้รับ ใบเสร็จรับเงิน ใบแจ้งหนี้ ธุรกรรม ประวัติธุรกรรม สถานะธุรกรรม และรายละเอียดอื่นๆ ของบริการหรือผลิตภัณฑ์ที่ท่านซื้อ

(ฉ) รายละเอียดด้านการตลาดและการสื่อสาร เช่น ตัวเลือกของท่านในการรับข้อมูลทางการตลาดจากเรา บริษัทในเครือ บริษัทคู่ค้า และตัวเลือกในการติดต่อสื่อสารของท่าน

(ช) รายละเอียดลูกค้าเป้าหมาย เช่น รหัสลูกค้าเป้าหมาย รถยนต์และสีรถยนต์ที่ใช้อยู่ในปัจจุบัน ข้อมูลการทดลองขับ แผนการซื้อ รถยนต์ที่ท่านสนใจ รุ่นที่ท่านสนใจ บันทึกข้อมูลการติดตาม (เช่น ข้อมูลการเยี่ยมชมศูนย์บริการรถยนต์ ข้อมูลการจอง) แหล่งที่มา (เช่น จากการมาเยี่ยมชมศูนย์บริการรถยนต์ มีผู้แนะนำมา มอเตอร์โชว์ จากลูกค้าปัจจุบัน เว็บไซต์เครือข่ายสังคมออนไลน์) เหตุผลที่ไม่สามารถปิดการขาย ความสนใจของท่านในกิจกรรมของ TMT

(ซ) รายละเอียดประวัติ เช่น บัญชีผู้ใช้ Connected Services ชื่อลงทะเบียนเข้าใช้หรือชื่อผู้ใช้ Application (เช่น T-Connect Application) รายละเอียดประวัติการใช้บริการและผลิตภัณฑ์ของเรา ภาพถ่าย ประวัติการติดต่อ ประวัติการร้องเรียน ความสนใจของท่าน ความต้องการ คำติชม และคำตอบในแบบสอบถามความพึงพอใจ

(ฌ) รายละเอียดทางเทคนิค เช่น ที่อยู่อินเทอร์เน็ตโพรโทคอล (Internet Protocol : IP) ประเภทและเวอร์ชั่นของเบราว์เซอร์ พฤติกรรมและรูปแบบการสืบค้นของท่าน คุกกี้ รหัสอุปกรณ์ (Device ID) รุ่นอุปกรณ์และประเภทของอุปกรณ์ ระยะเวลาและสถานที่ที่เข้าถึง

4.2 หากท่านให้ข้อมูลส่วนบุคคลของบุคคลอื่น เช่น ชื่อ นามสกุล รายละเอียดที่อยู่ และหมายเลขโทรศัพท์สำหรับการติดต่อฉุกเฉินแก่เรา หรือสมาชิกครอบครัวที่ใช้รถของท่าน ท่านต้องตรวจสอบให้แน่ใจว่าท่านมีอำนาจที่จะกระทำได้และเราได้รับอนุญาตอย่างถูกต้องตามกฎหมายให้ใช้ข้อมูลส่วนบุคคลของบุคคลเหล่านั้นตามนโยบายฯ นี้ โปรดให้นโยบายฯ นี้แก่บุคคลแหล่านั้นเพื่อให้รับทราบและ/หรือขอความยินยอม (หรือใช้ฐานทางกฎหมายอื่นๆ เป็นข้อยกเว้นความยินยอม) ให้ส่งมอบข้อมูลดังกล่าวให้แก่เราตามนโยบายฯ นี้

4.3 เราจะไม่ใช้ข้อมูลส่วนบุคคลประเภทที่มีความอ่อนไหว เช่น เชื้อชาติ เผ่าพันธุ์ ความคิดเห็นทางการเมือง ความเชื่อในลัทธิ ศาสนาหรือปรัชญา พฤติกรรมทางเพศ ประวัติอาชญากรรม ข้อมูลสุขภาพ ความพิการ ข้อมูลสหภาพแรงงาน ข้อมูลพันธุกรรม ข้อมูลชีวภาพ เป็นต้น เว้นแต่ในกรณีที่กฎหมายบัญญัติให้เราทำได้ หรือเมื่อท่านให้ความยินยอมไว้โดยชัดแจ้ง

ท่านจะต้องทำการตรวจสอบให้แน่ใจว่าข้อมูลส่วนบุคคลทั้งหมดที่ให้ไว้เป็นข้อมูลที่ครบถ้วน ถูกต้อง และเป็นจริง

5. วิธีการรับและเก็บรวบรวมข้อมูลส่วนบุคคล

(ก) ข้อมูลส่วนบุคคลที่ท่านให้แก่เรา: ท่านอาจให้ข้อมูลส่วนบุคคลของท่านแก่เราโดยตรง มักจะมีขึ้นเมื่อท่านติดต่อเราเมื่อต้องการสอบถามข้อมูล กรอกข้อมูลในแบบฟอร์มออนไลน์หรือกรอกเอกสาร การสมัครสมาชิกหรือลงทะเบียนเพื่อการรับหรือขอทราบข้อมูลผลิตภัณฑ์ บริการ หรือสิทธิประโยชน์ต่างๆ จากเรา หรือเมื่อท่านแสดงความคิดเห็นกลับมายังเรา

(ข) ข้อมูลส่วนบุคคลที่เราเก็บรวบรวมจากท่านโดยอัตโนมัติ: เราอาจเก็บรวบรวมข้อมูลทางเทคนิคบางประการเกี่ยวกับอุปกรณ์ของท่าน พฤติกรรมและรูปแบบการสืบค้นของท่าน ซึ่งเป็นข้อมูลส่วนบุคคลที่จัดเก็บโดยคุกกี้ (Cookies) และเทคโนโลยีอื่น ๆ ที่คล้ายกัน โดยเราจะแจ้งให้ท่านทราบก่อนการใช้งาน

(ค) ข้อมูลส่วนบุคคลที่ได้รับจากบุคคลภายนอก: บางครั้งเราจะได้รับข้อมูลส่วนบุคคลเกี่ยวกับท่านจากผู้อื่น เช่น บริษัทในเครือ ผู้แทนจำหน่ายรถยนต์โตโยต้า เลกซัส และโตโยต้าชัวร์ ผู้ให้บริการของเรา หรือบริษัทคู่ค้าของเรา หากบริษัทเหล่านั้นได้รับอนุญาตให้เปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่เราตามนโยบายความเป็นส่วนตัวของข้อมูลส่วนบุคคลของบุคคลดังกล่าว และ/หรือซึ่งท่านได้เคยให้ความยินยอมในการเปิดเผยข้อมูลไว้กับบุคคลดังกล่าวแล้วแต่กรณี

6. วัตถุประสงค์และฐานกฎหมายในการรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคล

6.1 เราเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์ต่อไปนี้ (เรียกรวมกันว่า "วัตถุประสงค์")

(ก) เพื่อจัดหาผลิตภัณฑ์และบริการให้แก่ท่าน: เพื่อบริหารจัดการ เข้าทำสัญญาและปฏิบัติหน้าที่ของเราตามสัญญา หรือข้อผูกพันใดๆ ก็ตามที่เรามีร่วมกับท่าน หรือองค์กรที่ท่านเป็นตัวแทน เช่น การจองการทดลองขับ การส่งมอบรถยนต์ การปฏิบัติตามสัญญาซื้อขายผลิตภัณฑ์ บริการที่เกี่ยวข้องกับการชำระเงิน ซึ่งรวมถึงการตรวจสอบ การยืนยัน และการยกเลิกธุรกรรม การรับประกันผลิตภัณฑ์ การเจรจาประกันภัยและบริการอื่นๆที่เกี่ยวข้องกับประกันภัย การลงทะเบียนให้บริการที่เกี่ยวกับรถยนต์และบริการอื่นๆ การส่งมอบแพคเกจต้อนรับ การให้บริการหลังการขาย เช่นการบำรุงรักษาและการจองการซ่อมรถยนต์ เพื่อระบุตำแหน่งรถยนต์ของท่าน การให้บริการ Connected Services แก่ท่าน เช่น ระบบนำทางเนวิเกเตอร์ บริการช่วยเหลือฉุกเฉิน บริการอำนวยความสะดวกและแก้ปัญหาต่างๆ นัดหมายศูนย์บริการ พร้อมตรวจสอบประวัติการซ่อมและข้อมูลรถยนต์ เพื่อพิจารณาการนำเสนอเงินกู้และคะแนนเครดิต เพื่อประมวลผลการจ่ายเงิน ออกใบเสร็จ จำนวนเงินที่ค้างชำระ ใบแจ้งหนี้ และหลักฐานการซื้อ เพื่อซื้อหรือขายรถยนต์มือสองหรือเสนอการประมูล เพื่อทำการประมูลรถยนต์ เพื่อแจ้งให้ท่านทราบเกี่ยวกับการเรียกคืนรถ การให้สิทธิประโยชน์ รวมถึงการให้บริการอื่นๆ ตามที่เรา และผู้แทนจำหน่ายรถยนต์โตโยต้า เลกซัส และโตโยต้าชัวร์ มีฐานะเป็นผู้ให้บริการ หรือได้รับการร้องขอจากท่าน เป็นต้น

(ข) การลงทะเบียนและการยืนยันตัวตน: เพื่อดำเนินการตรวจสอบและยืนยันตัวของท่าน ในการลงทะเบียนและเข้ารับบริการต่างๆ จากเรา

(ค) เพื่อปรับปรุงการดำเนินธุรกิจ ผลิตภัณฑ์และบริการ: เพื่อการประเมิน วิเคราะห์ จัดการ ปรับปรุง ดำเนินการวิจัย วางแผน ทำแบบสำรวจและวิเคราะห์เชิงสถิติ เพื่อนำไปพัฒนาระบบ คุณภาพและความปลอดภัยของผลิตภัณฑ์และการให้บริการของเรา เช่น ความพึงพอใจเกี่ยวกับผลิตภัณฑ์ ความพึงพอใจเกี่ยวกับการขายผลิตภัณฑ์หรือการให้บริการของผู้แทนจำหน่ายรถยนต์โตโยต้า เลกซัส และโตโยต้าชัวร์ เพื่อประเมินประสิทธิภาพในเรื่องผลิตภัณฑ์ สื่อดิจิทัล และแคมเปญทางการตลาดของเรา รูปแบบและกระแสความนิยมด้านการบริโภค พฤติกรรม เป็นต้น รวมถึงข้อมูลเกี่ยวกับความชอบและความสนใจของท่านในผลิตภัณฑ์หรือการบริการของเรา หรือเพื่อสร้างรายงานแบบรวมและเป็นนิรนาม เพื่อทราบถึงปัญหาและวิธีการแก้ไข หรือเพื่อการฝึกอบรมพนักงาน และการประเมินผลงานของพนักงาน เพื่อปรับปรุงธุรกิจ ผลิตภัณฑ์และบริการ

(ง) เพื่อจัดการความสัมพันธ์กับท่าน: เพื่อติดต่อสื่อสารกับท่านเกี่ยวกับผลิตภัณฑ์และบริการที่ท่านได้รับจากเรา บริษัทในเครือ ผู้แทนจำหน่ายรถยนต์โตโยต้า เลกซัส และโตโยต้าชัวร์ ผู้ให้บริการของเรา หรือจากบริษัทคู่ค้าของเรา เพื่อแจ้งเตือนท่านรวมไปถึงแจ้งเตือนการต่ออายุทะเบียนรถหรือประกัน เพื่อประมวลผลและอัปเดตข้อมูลของท่านในฐานะสมาชิกของเรา เพื่อให้ข้อมูลเกี่ยวกับรถยนต์ของท่าน จัดเตรียมรายงานการเดินทางและตรวจสอบสถานะและข้อมูลรถยนต์ เพื่อรักษาความสัมพันธ์กับลูกค้าของเรา เพื่ออำนวยความสะดวกให้แก่ท่านในการใช้ผลิตภัณฑ์และบริการ เพื่อการดำเนินการให้ความช่วยเหลือ ประสานงาน รับฟังความคิดเห็น หรือการตอบข้อซักถามที่เกี่ยวข้องกับผลิตภัณฑ์และบริการของเรา

(จ) การตลาดและการสื่อสาร: เพื่อการแจ้งข้อมูลข่าวสาร การประชาสัมพันธ์ การสื่อสาร และการส่งเสริมการขายผลิตภัณฑ์หรือการให้บริการของเราและ/หรือ ผู้แทนจำหน่ายรถยนต์โตโยต้า เลกซัส และโตโยต้าชัวร์ ผู้ให้บริการของเรา บริษัทคู่ค้า เพื่อส่งจดหมายเชิญให้ท่านร่วมงานกิจกรรมของเรา ผ่านช่องทางการติดต่อของเราและ/หรือ ผู้แทนจำหน่ายรถยนต์โตโยต้า เลกซัส และโตโยต้าชัวร์ ผู้ให้บริการของเรา บริษัทคู่ค้า ได้แก่ เว็บไซต์ อีเมล โทรศัพท์ โทรสาร ไปรษณีย์ SMS MMS หรือสื่อสังคมออนไลน์ต่างๆ เป็นต้น

(ฉ) การจัดการด้านเทคโนโลยีสารสนเทศ: เพื่อดูแลจัดการการดำเนินงานด้านเทคโนโลยีสารสนเทศ การจัดการระบบการสื่อสาร การรักษาและตรวจสอบความปลอดภัยด้านเทคโนโลยีสารสนเทศ และการตรวจสอบความปลอดภัยด้านเทคโนโลยีสารสนเทศ การจัดการธุรกิจเพื่อการปฏิบัติตามข้อกำหนด นโยบาย และกระบวนการภายใน

(ช) การปฏิบัติตามกฎหมาย: เพื่อปฏิบัติตามกฎหมาย กฎระเบียบ กฎเกณฑ์ คำสั่ง ข้อกำหนดและหน้าที่ตามกฎหมายของเรา

(ซ) ความเสี่ยง: เพื่อการจัดการความเสี่ยงตรวจสอบประสิทธิภาพ และประเมินความเสี่ยง

(ฌ) การปกป้องผลประโยชน์ของเรา: เพื่อวัตถุประสงค์ด้านความมั่นคงปลอดภัย เช่น การถ่ายภาพ และ บันทึกวิดิทัศน์ เพื่อใช้สิทธิของเราและปกป้องผลประโยชน์ของเราเมื่อจำเป็นและชอบด้วยกฎหมาย ตัวอย่างเช่น เพื่อตรวจจับ ป้องกัน และตอบสนองต่อข้อร้องเรียน เพื่อจัดการและป้องกันการสูญเสียทรัพย์สิน เพื่อตรวจจับและป้องกันการกระทำผิดภายในสถานที่หรือระบบคอมพิวเตอร์ของเรา

(ญ) การตรวจจับการทุจริต: เพื่อพิสูจน์ตัวตนของท่าน เพื่อตรวจสอบว่ามีการปฏิบัติตามกฎหมายและกฎระเบียบอื่นๆ (เช่น เพื่อปฏิบัติตามกฎด้านการป้องกันและปราบปรามการฟอกเงิน และป้องกันการทุจริต) รวมถึงการทำการตรวจสอบและบันทึกเป็นการภายใน การจัดการทรัพย์สิน ฐานข้อมูลด้านการทุจริต ระบบ และการควบคุมธุรกิจอื่นๆ

(ฎ) ธุรกรรมองค์กร: ในกรณีของการขาย การโอน การควบรวม การฟื้นฟูกิจการ หรือกรณีอื่นที่คล้ายกัน เราอาจส่งหรือโอนข้อมูลของท่านให้กับบุคคลที่สามหนึ่งฝ่ายหรือมากกว่าในฐานะที่เป็นส่วนหนึ่งของการดำเนินการดังกล่าว

(ฏ) ชีวิต: เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล

6.2 เราเก็บรวบรวม ใช้ เปิดเผย และ/หรือโอนข้อมูลส่วนบุคคลของท่านภายใต้หลักเกณฑ์หรือฐานทางกฎหมาย ประการใดประการหนึ่งต่อไปนี้

(ก) เพื่อปฏิบัติตามกฎหมายที่เราอยู่ภายใต้บังคับ

(ข) เพื่อปฏิบัติตามสัญญาที่ท่าน หรือองค์กรที่ท่านเป็นตัวแทน เป็นคู่สัญญากับเราหรือเพื่อใช้ในการดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญานั้น

(ค) เป็นการจำเป็นเพื่อประโยชน์โดยชอบตามกฎหมายของเราและของบุคคลภายนอก

(ง) เพื่อป้องกันหรือระงับอันตรายต่อชีวิต ร่างกาย หรือสุขภาพของบุคคล

(จ) เพื่อประโยชน์สาธารณะ สำหรับการดำเนินภารกิจเพื่อประโยชน์สาธารณะ หรือการใช้สิทธิของเจ้าหน้าที่ของรัฐ

(ฉ) ในกรณีที่จำเป็นต้องอาศัยความยินยอมจากท่านสำหรับกิจกรรมบางประเภทซึ่งเกี่ยวข้องกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน เราจะขอความยินยอมจากท่านก่อนการใช้ข้อมูลส่วนบุคคลของท่าน

6.3 ในกรณีที่เราอาจใช้ข้อมูลส่วนบุคคลของท่าน เพื่อการดำเนินการอย่างอื่นที่ไม่ได้ระบุไว้ข้างต้น เราจะมีหนังสือบอกกล่าวให้แก่ท่านเพื่อทราบเพิ่มเติม โดยจะระบุถึงข้อมูลที่ใช้เกี่ยวกับการดำเนินการดังกล่าวและจะดำเนินการขอความยินยอมจากท่านก่อนในกรณีที่ต้องได้รับความยินยอมจากท่าน

6.4 ในกรณีที่เรามีความจำเป็นต้องเก็บรวบรวมข้อมูลส่วนบุคคลจากท่านเพื่อปฏิบัติตามกฎหมายหรือสัญญาหรือมีความจำเป็นต้องให้ข้อมูลส่วนบุคคลเพื่อเข้าทำสัญญา แล้วท่านไม่สามารถให้ข้อมูลส่วนบุคคลแก่เราเมื่อมีการร้องขอ เราอาจไม่สามารถปฏิบัติตามวัตถุประสงค์ที่เกี่ยวข้องข้างต้นได้

7. การเปิดเผยข้อมูลส่วนบุคคล

7.1 เราอาจเปิดเผยข้อมูลส่วนบุคคลของท่านไปยังบุคคลภายนอกซึ่งเก็บรวบรวม ใช้หรือเปิดเผยข้อมูลส่วนบุคคล เพื่อวัตถุประสงค์ตามนโยบายฯฉบับนี้ โดยท่านสามารถอ่านนโยบายส่วนบุคคลของบุคคลภายนอกเหล่านั้นเพื่อศึกษาข้อมูลเพิ่มเติมเกี่ยวกับวิธีการที่บุคคลภายนอกดังกล่าวเก็บรวบรวม ใช้หรือเปิดเผยข้อมูลส่วนบุคคลของท่านได้ ซึ่งท่านเองก็ตกอยู่ภายใต้นโยบายความเป็นส่วนตัวเหล่านั้นแยกต่างหากด้วยเช่นกัน

7.2 เราอาจเปิดเผยข้อมูลส่วนบุคคลของท่านภายใต้วัตถุประสงค์ ให้แก่บุคคลที่สามดังต่อไปนี้

(ก) บริษัทในเครือของโตโยต้า: เนื่องจากเราเป็นส่วนหนึ่งของบริษัทในกลุ่มโตโยต้า ซึ่งร่วมมือกันในการให้บริการลูกค้าและให้บริการระบบต่างๆ เราอาจมีความจำเป็นต้องโอนข้อมูลส่วนบุคคลของท่านไปยังบริษัทในเครือดังต่อไปนี้ หรืออนุญาตให้บริษัทในเครือเข้าถึงข้อมูลส่วนบุคคลของท่าน เพื่อวัตถุประสงค์ที่ระบุไว้ข้างต้น

2) บริษัทสยามโตโยต้าอุตสาหกรรม จำกัด

4) บริษัท โตโยต้า ออโต้ บอดี้ ประเทศไทย จำกัด

5) บริษัท โตโยต้า บอดี้ เซอร์วิส จำกัด

6) บริษัท เทคโนโลยียานยนต์โตโยต้า จำกัด

7) บริษัท โตโยต้า ลีสซิ่ง (ประเทศไทย) จำกัด

8) บริษัท ข้าวรัชมงคล จำกัด

9) บริษัท ฮีโน่ แมนูแฟคเจอริ่ง (ประเทศไทย) จำกัด

10) บริษัท โตโยต้า มอเตอร์ คอร์ปอเรชัน (ญี่ปุ่น)

11) บริษัท โตโยต้า มอเตอร์ เอเชีย แปซิฟิค (สิงคโปร์)

(ข) ผู้แทนจำหน่ายรถยนต์โตโยต้า เลกซัส และโตโยต้าชัวร์: เราอาจแบ่งปันและรับข้อมูลส่วนบุคคลของท่านจากผู้แทนจำหน่ายและศูนย์บริการรถยนต์ที่ท่านเลือกหรือที่อยู่ใกล้ท่านเพื่อให้บริการแก่ท่าน ท่านสามารถดูข้อมูลเพิ่มเติมได้ที่ https://www.toyota.co.th, https://www.lexus.co.th/ และ https://www.toyotasure.com/

(ค) ผู้ให้บริการของเรา: เราอาจแบ่งปันข้อมูลส่วนบุคคลของท่านให้แก่ผู้ให้บริการหรือผู้จัดหาผลิตภัณฑ์บริการจากภายนอกเพื่อให้บริการต่างๆ แทนเราหรือเพื่อช่วยในการจัดหาผลิตภัณฑ์และบริการให้แก่ท่าน ซึ่งรวมถึง แต่ไม่จำกัดเพียง

1) ผู้ให้บริการด้านโลจิสติกส์และการขนส่ง

2) ผู้ให้บริการช่วยเหลือฉุกเฉิน

3) บริษัทที่ให้บริการด้านการวิจัยและสำรวจตลาด

4) บริษัทที่ให้บริการด้านการวิเคราะห์

5) บริษัทที่ให้บริการด้านการตลาด สื่อโฆษณา การออกแบบ การสร้างสรรค์ และการสื่อสาร

6) ผู้ให้บริการด้านโทรคมนาคมและการสื่อสาร

7) ผู้ให้บริการด้านการจัดเก็บข้อมูลและบริการคลาวด์

(ง) บริษัทคู่ค้าของเรา: ทั้งในประเทศและต่างประเทศ เช่น ธุรกิจผลิตและจำหน่ายชิ้นส่วนอะไหล่รถยนต์ (Supplier) ธุรกิจรถเช่า ธุรกิจประกันภัย ธุรกิจสถาบันการเงิน ธุรกิจค้าปลีก ธุรกิจโทรคมนาคม ธุรกิจร้านอาหาร เป็นต้น ที่เราอาจร่วมเสนอหรือเสนอผลิตภัณฑ์หรือบริการให้แก่ท่าน

(จ) บุคคลภายนอกตามที่กฎหมายกำหนด: ในบางกรณี เราอาจต้องเปิดเผยหรือแบ่งปันข้อมูลส่วนบุคคลของท่านเพื่อปฏิบัติตามกฎหมาย หรือกฎข้อบังคับ ซึ่งรวมถึง การปฏิบัติตามหน่วยงานที่บังคับใช้กฎหมาย ศาล เจ้าพนักงาน หน่วยงานรัฐ หรือบุคคลภายนอกอื่นๆ ในกรณีที่เราเชื่อว่าจำเป็นจะต้องปฏิบัติตามหน้าที่ตามกฎหมายหรือกฎข้อบังคับทางกฎหมาย หรือเพื่อการปกป้องสิทธิของเรา สิทธิของบุคคลอื่น หรือเพื่อความปลอดภัยของบุคคล หรือเพื่อตรวจสอบ ป้องกัน หรือจัดการเกี่ยวกับปัญหาการทุจริต หรือด้านความมั่นคงหรือความปลอดภัย

(ฉ) ที่ปรึกษา: ซึ่งรวมถึงทนาย เจ้าหน้าที่เทคนิค และผู้ตรวจสอบบัญชีที่ช่วยเหลือในการดำเนินธุรกิจของเรา และใช้สิทธิเรียกร้องตามกฎหมายและต่อสู้สิทธิเรียกร้องในทางกฎหมาย

(ช) ผู้รับโอนสิทธิและ/หรือหน้าที่: ในกรณีของการฟื้นฟูกิจการ การควบรวมกิจการ การโอนธุรกิจไม่ว่าทั้งหมดหรือส่วนหนึ่ง การขาย การซื้อ การดำเนินกิจการร่วมค้า การมอบ การโอน หรือการจำหน่วยส่วนหนึ่งหรือทั้งหมดของธุรกิจ ทรัพย์สิน หรือหุ้น หรือธุรกรรมอื่นที่คล้ายกัน

7.3 เราอาจเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่บุคคลภายนอกในกรณีที่กฎหมายกำหนดหรืออนุญาต ดังนั้นหากกฎหมายกำหนดว่าต้องได้รับความยินยอมจากท่าน เราจะขอความยินยอมจากท่านก่อน

8. การโอนและคุ้มครองข้อมูลส่วนบุคคล

8.1 เนื่องจากเราเป็นส่วนหนึ่งของบริษัทในเครือของโตโยต้า อาจมีการโอนหรือส่งต่อข้อมูลส่วนบุคคลของท่านระหว่างกัน เพื่อการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลภายใต้วัตถุประสงค์ข้างต้น เพื่อให้ท่านสามารถเข้าถึงบริการของเรา เพื่อให้การดูแลลูกค้า เพื่อตัดสินใจเกี่ยวกับการปรับปรุงบริการ เพื่อการพัฒนาเนื้อหา หรือเพื่อวัตถุประสงค์อื่น ที่ระบุในนโยบายฯ นี้

8.2 เมื่อมีการโอนข้อมูลส่วนบุคคลของท่านไปยังบริษัทในเครือของโตโยต้าในต่างประเทศ เราจะปฏิบัติตามกฎหมายที่เกี่ยวข้องกับข้อมูลส่วนบุคคลของท่าน รวมถึงเราจะปฏิบัติตามมาตรการความปลอดภัยเพื่อให้แน่ใจว่ามีการคุ้มครองข้อมูลส่วนบุคคลของท่านในระดับที่เพียงพอ และเราจะตรวจสอบให้แน่ใจด้วยว่า ผู้รับโอนข้อมูลในต่างประเทศจะให้ความคุ้มครองข้อมูลส่วนบุคคลของท่านด้วยมาตรฐานการคุ้มครองที่เทียบเท่ากับการคุ้มครองภายใต้กฎหมายของประเทศไทยเช่นเดียวกัน หากจำเป็น

8.3 ในกรณีที่เรามีความจำเป็นในการโอนข้อมูลส่วนบุคคลของท่านไปยังต่างประเทศ หากเราพบว่ามาตรฐานการคุ้มครองข้อมูลส่วนบุคคลในต่างประเทศนั้นไม่เพียงพอตามหลักเกณฑ์การให้ความคุ้มครองข้อมูลส่วนบุคคลที่คณะกรรมการประกาศกำหนด เราจะขอความยินยอมจากท่านหรืออาศัยฐานทางกฎหมายอื่นๆ ที่เกี่ยวข้องซึ่งอนุญาตให้กระทำได้เพื่อโอนข้อมูลส่วนบุคคลของท่านออกนอกประเทศไทย

9. ระยะเวลาในการเก็บข้อมูล

9.1 เราจะเก็บข้อมูลส่วนบุคคลเป็นระยะเวลาเท่าที่จำเป็น เพื่อดำเนินการตามวัตถุประสงค์ที่กำหนดไว้ในนโยบายนี้ และตามหน้าที่ของเราภายใต้กฎหมาย โดยหลังจากข้อมูลส่วนบุคคลของท่านไม่มีความจำเป็นหรือไม่มีกฎหมายให้สามารถเก็บได้อีกต่อไป เราจะลบหรือทำลายข้อมูลส่วนบุคคลนั้น โดยไม่ต้องแจ้งให้ท่านทราบ

9.2 ระยะเวลาในการเก็บข้อมูลอาจแตกต่างกันขึ้นอยู่กับวัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคล ในกรณีที่จะนำข้อมูลส่วนบุคคลมาใช้เป็นระยะเวลาสั้นๆ เช่น เพื่องานใดงานหนึ่งเป็นการเฉพาะ กิจกรรมทางการตลาด หรือเพื่อวัตถุประสงค์ในการสรรหาบุคลากร เราอาจลบหรือทำลายข้อมูลนั้นหลังสิ้นสุดระยะเวลาดังกล่าว

9.3 ท่านมีสิทธิที่จะให้เราลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลเป็นข้อมูลที่ไม่สามารถระบุตัวท่านได้ในบางกรณี เว้นแต่เรามีความจำเป็นที่จะต้องเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้ตามกฎหมายกำหนด

10. นโยบายความเป็นส่วนตัวของผู้เยาว์

ผลิตภัณฑ์ บริการและเว็บไซต์ของเราไม่ได้มีเป้าหมายหรือเจตนาที่จะเก็บรวบรวมข้อมูลส่วนบุคคลจากผู้เยาว์ที่อายุต่ำกว่า 20 ปี บุคคลเสมือนไร้ความสามารถ และบุคคลไร้ความสามารถ หากท่านเป็นผู้เยาว์ บุคคลเสมือนไร้ความสามารถ หรือบุคคลไร้ความสามารถซึ่งต้องการจะติดต่อดำเนินการกับเรา ท่านต้องได้รับความยินยอมจากผู้ปกครองตามที่กฎหมายกำหนด ผู้พิทักษ์ตามกฎหมายหรือผู้อนุบาลก่อนที่จะติดต่อเราหรือให้ข้อมูลส่วนบุคคลของท่านแก่เรา

11. ผู้แทนจำหน่ายรถยนต์โตโยต้า เลกซัส และโตโยต้าชัวร์

TMT และผู้แทนจำหน่ายเป็นนิติบุคคลแยกจากกันและต่างมีนโยบายความเป็นส่วนตัวของตนเอง หากท่านมีข้อสงสัยเกี่ยวกับแนวทางปฎิบัติในการคุ้มครองข้อมูลส่วนบุคคลของผู้แทนจำหน่าย รวมไปถึงหากท่านไม่ต้องการรับการแจ้งข้อมูลข่าวสาร การประชาสัมพันธ์ การสื่อสาร และการส่งเสริมการขายผลิตภัณฑ์หรือการให้บริการของผู้แทนจำหน่ายที่ไม่เกี่ยวข้องกับ TMT กรุณาติดต่อไปที่ผู้แทนจำหน่ายนั้นโดยตรง

เมื่อท่านซื้อหรือเช่าซื้อรถยนต์จากผู้แทนจำหน่าย ผู้แทนจำหน่ายจะเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่เรา ผู้แทนจำหน่ายและเราต่างเป็นนิติบุคคลแยกจากกันและท่านควรอ่านนโยบายความเป็นส่วนตัวของผู้แทนจำหน่ายเพื่อให้มั่นใจว่าท่านเข้าใจแนวทางและวิธีปฎิบัติในการคุ้มครองข้อมูลส่วนบุคคลของผู้แทนจำหน่ายนั้นๆ นอกจากนี้ เนื่องจากโดยทั่วไปผู้แทนจำหน่ายมักเป็นช่องทางแรกในการติดต่อของท่าน ผู้แทนจำหน่ายจึงเป็นผู้ที่สามารถให้คำตอบแก่ท่านเกี่ยวกับแนวทางปฎิบัติในการคุ้มครองข้อมูลส่วนบุคคลได้ และแม้ TMT จะสนับสนุนให้ผู้แทนจำหน่ายตรวจสอบให้มั่นใจว่าได้ปฎิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลที่เกี่ยวข้องอย่างเต็มที่ อีกทั้งให้ข้อมูลเกี่ยวกับหน้าที่ในการคุ้มครองข้อมูลส่วนบุคคลแก่ผู้แทนจำหน่ายแล้ว แต่ TMT ไม่มีส่วนรับผิดชอบในการปฎิบัติตามกฎหมายที่เกี่ยวข้องของผู้แทนจำหน่าย

12. สิทธิในข้อมูลส่วนบุคคลของท่าน

ท่านมีสิทธิต่อไปนี้เกี่ยวกับข้อมูลส่วนบุคคลของท่านที่อยู่ในความครอบครองของเรา หากท่านประสงค์จะขอใช้สิทธิ ท่านสามารถติดต่อเราได้ตามรายละเอียดในหัวข้อ "วิธีการติดต่อเรา" ข้างต้น

12.1 สิทธิในการเข้าถึง

ท่านอาจขอเข้าถึงหรือขอทราบรายละเอียดของข้อมูลส่วนบุคคลที่ท่านให้ไว้แก่เราได้ เว้นแต่ เป็นการปฏิเสธตามกฎหมายหรือคำสั่งศาล หรือ การเข้าถึงหรือขอทราบรายละเอียดนั้นจะส่งผลกระทบที่อาจก่อให้เกิดความเสียหายต่อสิทธิและเสรีภาพของผู้อื่น

12.2 สิทธิในการแก้ไขข้อมูลให้ถูกต้อง

ท่านมีสิทธิขอแก้ไขข้อมูลส่วนบุคคลของท่านหากข้อมูลส่วนบุคคลเกี่ยวกับท่านที่อยู่ในความครอบครองของเรานั้นไม่ถูกต้องหรือไม่สมบูรณ์

12.3 สิทธิในการขอให้ลบหรือทำลายข้อมูล

ท่านมีสิทธิขอให้เราลบหรือทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวท่านได้ ในกรณีดังต่อไปนี้

(ก) ข้อมูลส่วนบุคคลที่ไม่มีความจำเป็นที่จะต้องดำเนินการตามวัตถุประสงค์ในการเก็บรวบรวมหรือใช้อีกต่อไป

(ข) ข้อมูลส่วนบุคคลที่ท่านได้เพิกถอนความยินยอมให้เราทำการเก็บรักษา ใช้ และเปิดเผย และเราได้ทำการตรวจสอบแล้ว ไม่มีเหตุตามกฎหมายที่เราจะสามารถเก็บรวบรวมหรือใช้อีกต่อไป

(ค) ข้อมูลส่วนบุคคลที่ท่านได้ทำการคัดค้านมิให้เราทำเก็บรวบรวมหรือใช้อีกต่อไป และเราไม่สามารถปฏิเสธคำขอคัดค้านโดยอาศัยข้อยกเว้นทางกฎหมายที่มีผลใช้บังคับ

(ง) ข้อมูลส่วนบุคคลที่ท่านขอคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรง

(จ) ข้อมูลส่วนบุคคลนั้นมีการเก็บรวบรวม ใช้ และเปิดเผยโดยมิชอบด้วยกฎหมาย

ท่านมีสิทธิขอให้ลบหรือทำลายข้อมูลส่วนบุคคลที่ท่านให้ไว้ข้างต้น เว้นแต่เข้าข้อยกเว้นตามกฎหมาย เช่น การเก็บข้อมูลส่วนบุคคลนั้นมีความจำเป็นตามวัตถุประสงค์เพื่อการปฏิบัติตามสัญญา หรือเพื่อวัตถุประสงค์ในการก่อตั้งสิทธิเรียกร้องตามกฎหมาย ปฏิบัติตาม ใช้สิทธิเรียกร้องตามกฎหมาย หรือยกขึ้นต่อสู้ข้อสิทธิเรียกร้องตามกฎหมาย หรือวัตถุประสงค์อื่นที่กฎหมายกำหนดไว้

12.4 สิทธิในการจำกัดการใช้

ท่านมีสิทธิขอให้เราระงับการใช้ข้อมูลส่วนบุคคลของท่านได้ในกรณีดังต่อไปนี้

(ก) ท่านได้ขอให้เราแก้ไขข้อมูลส่วนบุคคลของท่านให้ถูกต้อง เป็นปัจจุบัน สมบูรณ์ และเราอยู่ในขั้นตอนการตรวจสอบคำขอของท่าน

(ข) ท่านได้ขอให้ระงับการใช้ข้อมูลที่เราอาจเก็บรวบรวม ใช้ หรือเปิดเผยโดยมิชอบ แทนการลบหรือทำลายข้อมูลส่วนบุคคลดังกล่าว

(ค) เราหมดความจำเป็นในการเก็บข้อมูลส่วนบุคคลของท่านตามวัตถุประสงค์ในการเก็บรวบรวม แต่ท่านมีความจำเป็นต้องขอให้เราเก็บรักษาไว้เพื่อใช้ในการก่อตั้งสิทธิเรียกร้องตามกฎหมาย การปฏิบัติตามหรือการใช้สิทธิเรียกร้องตามกฎหมาย หรือการยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย เพื่อประโยชน์ของท่าน

(ง) ท่านได้คัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านโดยอาศัยหรืออ้างประโยชน์สาธารณะ หรือการใช้อำนาจรัฐ หรือประโยชน์โดยชอบด้วยกฎหมาย และเราอยู่ในขั้นตอนการตรวจสอบคำขอของท่าน

(จ) ท่านได้คัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านโดยอาศัยหรืออ้างการศึกษาวิจัยทางวิทยาศาสตร์ ประวัติศาสตร์ หรือสถิติ (หากมี) และเราอยู่ในขั้นตอนการตรวจสอบคำขอของท่าน

12.5 สิทธิในการคัดค้าน

ท่านมีสิทธิคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลได้ ในกรณีดังต่อไปนี้

(ก) เป็นการดำเนินการเพื่อประโยชน์โดยชอบด้วยกฎหมายของเราหรือของบุคคลอื่น

(ข) เป็นการดำเนินการเพื่อประโยชน์สาธารณะ หรือการใช้อำนาจรัฐที่ได้มอบให้แก่เรา

(ค) กรณีที่เราเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ทางการตลาดแบบตรง

(ง) เป็นการดำเนินการเพื่อวัตถุประสงค์เกี่ยวกับการศึกษาวิจัยทางวิทยาศาสตร์ ประวัติศาสตร์ หรือสถิติ (หากมี)

หากท่านใช้สิทธิในการคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลดังกล่าว ท่านมีสิทธิแจ้งความประสงค์ว่าจะให้เราลบหรือจำกัดการใช้ข้อมูลส่วนบุคคลของท่านเพิ่มเติมได้

12.6 สิทธิในการโอนย้าย

ท่านมีสิทธิขอรับข้อมูลส่วนบุคคลของท่านที่เราเก็บรวบรวมไว้ โดยขอให้เราส่งข้อมูลดังกล่าวให้ท่านในรูปแบบเอกสารหรือข้อมูลอิเล็กทรอนิกส์โดยวิธีการอัตโนมัติได้ เว้นแต่ การขอโอนย้ายข้อมูลดังกล่าวไม่สามารถดำเนินการได้ภายใต้ข้อจำกัดของวิธีการของเรา

12.7 สิทธิในการเพิกถอนความยินยอม

ท่านมีสิทธิถอนความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยได้ หากเป็นกรณีที่ท่านได้เคยให้ความยินยอมไว้กับเรา เว้นแต่มีข้อจำกัดสิทธิในการถอนความยินยอมโดยกฎหมาย หรือการปฏิบัติหน้าที่ตามสัญญาของเราที่เป็นประโยชน์แก่ท่าน ทั้งนี้ การถอนความยินยอมของท่านจะไม่ส่งผลกระทบต่อ การเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้ว

12.8 สิทธิในการร้องเรียน

ท่านมีสิทธิร้องเรียนเกี่ยวกับการเก็บรวบรวม ใช้ เปิดเผยข้อมูลส่วนบุคคลได้ ในกรณีที่พบว่าเราฝ่าฝืนหรือไม่ปฏิบัติตามกฎหมาย โดยท่านสามารถร้องเรียนได้ผ่านช่องทางการติดต่อของเรา และท่านอาจร้องเรียนกรณีดังกล่าวไปยังคณะกรรมการคุ้มครองข้อมูลส่วนบุคคลได้

13. การแก้ไขนโยบายฯ นี้

13.1 เราอาจแก้ไขนโยบายฯ นี้เป็นครั้งคราวเพื่อให้สอดคล้องกับการใช้ข้อมูลส่วนบุคคลของท่านที่เปลี่ยนแปลงไป และเพื่อให้สอดคล้องกับกฎหมายที่บังคับใช้ โดยเราจะแจ้งนโยบายที่เปลี่ยนแปลงให้ท่านทราบผ่านช่องทางการติดต่อของเรา

3. What are Personal Data?

"Personal Data" means any information that can directly or indirectly identify a person but excludes the information of a particular deceased.

4. What Personal Data Are Collected?

4.1 The Personal Data that we collect depends on your relationship with us and the services or products you need from us. Below are parts of the types of the Personal Data about you that we may collect, use, disclose and / or transfer abroad.

(A) Personal Details such as name prefix, name, surname, gender, age, occupation, work position, work place, education, nationality, date of birth, marital status, information on government-issued cards (such as identification card number, passport number, tax identification number, information of car driver's license, etc.), signature, sound recording, recording of telephone conversations, photos, CCTV footage, house registration, and other identification information.

(B) Contact Details such as address, telephone number, fax number, location information, email address, LINE ID, Facebook account, Instagram ID and other IDs from social online networking websites.

(C) Car Details such as vehicle serial number, license plate number, car brand, model, year, color, engine number, car body number, car type, mileage, battery, voltage, oil level, braking wear, location and movement data (such as time, position, speed), car insurance details, decorative set/devices, details of accessories for Connected Service (such as SIM card, transceivers), car registration booklet, car inspection document, detailed information received from the use of Connected Services, GPS data and car location, car history report and other related information of car.

(D) Financial Details such as credit and debit card information, account number and type of account, PromptPay information, current assets, income and expenses, and other financial information.

(E) Transaction Details such as payment details, date and / or time of payment, payment amount, payment method, details about refunding, registration, interests, down payments, installment payment amounts and total number of installments, date and place of purchase of the product or service, address / date and time of car delivery, application form for services, preemption document, booking receipt, receiver signature, financial receipt, invoice, transaction, transaction history, transaction status, and other details of the services or products you purchase.

(F) Marketing and Communication Details such as your choice to receive marketing information from us, affiliates, business partner companies, and your communication options.

(G) Details of Target Customers such as codes of target customers, cars and car colors that are currently used, test drive information, car purchase plans, cars for your interest, models for your interest, record of tracking information (such as information about visits to car service center, booking information) sources (for example, from visiting car service centers, current customers’ advise to visit motor shows, social online networking websites), reasons of no sale close, and your interest in TMT activities.

(H) Profile Details such as Connected Services user account, login name or application user name (such as T-Connect Application), history of use of our services and products, photos, contact history, complaint history, your interests, demands, feedbacks, and answers in the satisfaction questionnaire.

(I) Technical Details such as the Internet Protocol (IP) address, browser type and version, your search behavior and style, cookies, device ID, device model and device type, duration and location of access.

4.2 If you provide Personal Data of any other person such as name, surname, address details and telephone number for emergency contact to us or family members who use your car, you must ensure that you have the authority to do so and we are legally permitted to use their Personal Data in accordance with this Policy. Please give this policy to those people for their acknowledgment and / or to request for their consent (or use other legal bases as an exception to consent) to deliver such data to us in pursuance of this Policy.

4.3 We will not use the sensitive Personal Data such as race, ethnic origin, political opinions, beliefs in sect, religion or philosophy, sexual behavior, criminal history, health information, disability, labor union information, genetic information, biological information, etc., except in the cases where the law requires us to do so or when you give your explicit consent.

You must ensure that all Personal Data provided are complete, accurate and true.

5. Methods of Receiving and Collecting Personal Data

We may receive and collect your Personal Data via the following means.

(A) Personal Data you provide to us: You may provide your personal information directly to us. 6.1 We collect, use and disclose the Personal Data for the following purposes (collectively called “Purposes”).

(B) Registration and identity verification: To conduct examination and verification of your identity in the registration and requests to receive our services.

(C) To improve the business operations, products and services: To make assessment, analysis, management, improvement, research, planning, surveying and statistical analysis in order to develop the quality system and safety of our products and services, such as product satisfaction, satisfaction about the product sales or services of Toyota, Lexus and Toyota Sure car dealers so as to evaluate the effectiveness of our products, digital media and marketing campaigns, consuming modes and trends, behavior, etc., including the information about your preferences and interests in our products or services or to create aggregated and anonymous reports so as to learn about the problems and solutions or the staff training and the employee performance evaluation for businesses, products and services improvement.

(E) Marketing and communication: To provide information, news, public relations, communication and sale promotion of our products or services and / or dealers of Toyota, Lexus and Toyota Sure, our service providers as well as business partner companies; to send you invitations to participate in our activities via our contact channels and / or dealers of Toyota, Lexus and Toyota Sure, our service providers, business partner companies including websites, email, telephone, fax, mail, SMS, MMS or various social online media, etc.

(F) Information technology management: To manage the information technology operations, the communication systems, the information technological security and inspection as well as the safety and security examination of the business management for the compliance with the internal policies and procedures.

(C) Our Service Providers: We may share your Personal Data with the service providers or the third-party service-providers to offer various services on our behalf or to help provide products and services to you, including but not limited to

1) Logistics and transportation service providers,

2) Emergency roadside assistance service providers,

3) Companies that provide market research and survey services,

4) Analysis services companies,

5) Companies that provide marketing services, advertising media, creative design and communication services,

6) Telecommunications and communication service providers, and

7) Data storage and cloud service providers.

(D) Our Business Partner Companies: They are in and outside the country, such as the manufacturers and suppliers of automotive spare parts, car rental business, insurance business, financial institution business, retail business, telecommunication business, restaurant businesses, etc., which may join us to offer products or services to you.

(E) Third Parties as Required by Law: In some cases, we may have to disclose or share your Personal Data in order to comply with the laws or regulations, including compliance with the law enforcement agencies, courts, competent officials, government offices or other third parties in the event that we believe we need to comply with the legal duties or regulations or need to protect our rights, rights of others or the safety of people or to investigate, prevent or manage fraud, stability or security issues.

(F) Advisors: They include lawyers, technical officials and account auditors who assist in our business operations and exercise the rights of claims and to defend against them.

(G) Assignees of Rights and / or Duties: In the case of a business rehabilitation, business merger, business transfer, either wholly or partially, sales, purchases, joint ventures, grants, transfers, or sale of part or all of a business, property or stock or other similar transactions.

7.3 We may disclose your Personal Data to the third parties in the event that the law requires or permits. Therefore, if the law requires your consent, we will ask for your consent first.

8. Transfer and Protection of Personal Data

8.1 Since we are part of affiliates of Toyota, there may be a transfer or forward of your Personal Data within the Group to collect, use and disclose the Personal Data for the above Purposes. This will let you access our services for the customer care, for the decision making towards the service improvement, for the development of contents or for other purposes specified in this Policy.

8.2 When your Personal Data is transferred to a Toyota affiliate overseas, we will comply with the laws in connection to them. We will also comply with the security measures to ensure the protection of your Personal Data at an adequate level and we will check to assure that the transferee in foreign countries will protect your Personal Data under the same standard of protection as that under Thai laws if necessary.

8.3 In the event that we need to transfer your Personal Data to another country, if we find that the Personal Data protection standards in that foreign country is not equal to the privacy protection regulations announced by the Commission, we will ask for your consent or use other legal bases that permit to transfer your Personal Data off Thailand.

9. Period of Data Collection

9.1 We will collect Personal Data for as long as necessary to carry out the Purposes set out in this Policy and pursuant to our duties under law. After your Personal Data is no longer needed or no law is available to enforce the collection, we will delete or destroy those Personal Data without notifying you.

9.2 The data collection periods may vary depending on the Personal Data collection objectives. In the event that the Personal Data are used for a short period of time, for example for a particular job, for the marketing activities, or for the purpose of recruiting personnel, we may delete or destroy that information after the end of the said period.

9.3 You have the right to ask us to delete, destroy or make Personal Data non-personally identifiable in some cases unless we need to keep your Personal Data in accordance with the laws.

10. Privacy Policy of Minors

Our products, services, and websites do not have the goal or intent to collect Personal Data from minors under 20 years of age, quasi-incompetent persons and incompetent persons. If you are one of those people who want to contact us, you must obtain the consent of the parent stipulated by law, legal guardian or guardian before contacting us or providing us with your personal information.

11. Dealers of Toyota, Lexus and Toyota Sure

TMT and its dealers are separate legal entities and each have its own privacy policy. If you have any questions about the dealer's Personal Data protection practices and / or if you don't want to receive news updates, public relations, communication and sale promotion of products or services provided by a dealer not related with TMT, please contact that dealer directly.

When you buy or hire purchase a car from a dealer, it will disclose your Personal Data to us. The dealer and us are separate legal entities and you should read the privacy policy of the dealer to understand its guidelines and procedures of the personal information protection. This is because dealers in general are often the first contact channel for you. The dealer is therefore able to provide you with answers regarding the protection of the Personal Data, and although TMT encourages the dealers to check that they comply with the Personal Data protection laws in full and TMT provides the information about the Personal Data protection duties to those dealers, TMT is not responsible for the dealers’ compliance with the applicable laws.

12. Rights in your Personal Data

You have the following rights in your Personal Data that are in our possession. If you wish to exercise your rights, you can contact us pursuant to the details in the topic "Contact Us" above.

12.1 Right of Access / obtain record

You may request to access or to know the details of the personal information you have provided to us except for the case of denial by law or court order or except for the case that the access or request to access will make damage to the rights and liberty of others.

12.2 Rights to Rectification Data

You have the right to request for the correction of your Personal Data if those that are in our possession are wrong or incomplete.

12.3 Rights to Erasure Data

You can request us to delete or destroy your Personal Data or make them unidentifiable to you in any of the following cases.

(A) The Personal Data that are no longer necessary for the purposes of collection or use.

(B) The Personal Data for which you have withdrawn your consent for us to collect, use and disclose and we have investigated to find no legal basis for us to make further collection or use.

(C) The Personal Data that you have objected that we should not further collect nor use them and we cannot reject the objection with valid legal exceptions.

(D) The Personal Data that you have objected to collect, use or disclose for direct marketing purposes.

(E) The Personal Data are collected, used and disclosed illegally.

You have the right to request for the deletion or destruction of the personal information you have provided above except for the cases of legal exceptions such as collecting for the purpose of agreement performance or establishing legal claims, compliance with the legal claims, using to fight against the legal claims or other purposes specified by laws.

12.4 Rights to Restrict Use

You have the right to ask us to suspend the use of your Personal Data in any of the following cases:

(A) You have requested us to correct your Personal Data to be current or complete, and we are in the process of reviewing your request.

(B) You have requested to suspend the use of information that we may collect, use or disclose illegally rather than delete or destroy it.

(C) We have no collecting purpose to collect your Personal Data but you have asked us to store it for the establishment, compliance and exercise of legal claims or for defense against legal claims for your benefit.

(D) You have objected to the collection, use, or disclosure of your Personal Data for the reason of public interest or the use of state power or legal benefits; and we are in the process of reviewing your request.

(E) You have objected to the collection, use or disclosure of your Personal Data based or with citation on scientific, historical or statistical research (if any); and we are in the process of reviewing your request.

12.5 Right to Object

You have the right to object the collection, use or disclosure of the Personal Data in the following cases.

(A) They are for legitimate interests of ours or of other people.

(B) They are for the public benefit or the use of state power that has been given to us.

(C) They are for direct marketing purposes.

(D) They are for scientific, historical or statistical research purposes (if any).

If you exercise the right to object the collection, use or disclosure of such Personal Data, you can also request us to delete them or restrict such use.

12.6 Right to Transfer

You are entitled to receive your Personal Data that we have collected by requesting us to send you such information in a document or electronic form unless the data transfer cannot be implemented because of the limitations of our procedures.

12.7 Right to Withdraw Consent

You have the right to withdraw the consent to collect, use or disclose the Personal Data if you give the said consent to us except for the cases of the restriction on such withdrawing rights by law or by our contractual performance duties that are of interest to you. Withdrawing your consent will not affect the collecting, using, or disclosing of the Personal Data that you have already given consent to.

12.8 Right to Make Complaints

You have the right to issue complaints about the collection, use, and disclosure of the Personal Data. In the event that we violate or do not comply with the law, you can make a complaint through our contact methods and you may make a complaint to the Personal Data Protection Commission.

13. Amendments to this Policy

13.1 We may amend this Policy from time to time in accordance with the change of use of your Personal Data and in accordance with the applicable laws. We will notify you about the changed policy via our contact methods.

13.2 We will use the latest version of this Policy for reference on how to collect, use and disclose your Personal Data.

This Policy comes into effect on 27 May 2020 and supersedes all of our privacy policies earlier designated.
